VENTURELLI v. ARC CMTY SERV., INC. (11/26/03 - No.
02-2294)
In a Title VII action, summary judgment to defendant is affirmed where
plaintiff does not present direct or circumstantial evidence sufficient
to proceed under the direct method of proving discrimination, and is
unable to produce evidence under the indirect method for establishing
the third or fourth elements of a prima facie case.

EEOC v. PAC. MAR. ASS'N (11/24/03 - No. 02-35536)
In a sexual harassment case, brought by the EEOC on behalf of
intervenor, there was no legally sufficient basis for the jury to find a
connection with an employment relationship between defendant and
intervenor and as a result, the district court erred when it denied
defendant's motion for judgment as a matter of law.

RABKIN v. OREGON HEALTH SCIENCES (11/24/03 - No. 02-35077)
Defendant's denied motion to reduce a jury verdict under the Oregon
Tort Claims Act is reversed, as an award under Oregon's Whistleblower
Law is limited to $200,000. District Court had jurisdiction in the
underlying action pursuant to 28 U.S.C. section 1331 based on
plaintiff's First Amendment claim under 42 U.S.C. section 1983.

Summary judgment to defendant/employer is reversed where a reasonable
jury could find that employee's attempted deviation from his direct
route to obtain non-emergency vehicle maintenance was something which
employer might reasonably be deemed to have anticipated and assented to.

SACRAMENTO COUNTY
(MCGINNIS) (11/24/03 - No. S103487)
In a sexual harassment action concerning the application of liability
of California's Fair Employment and Housing Act (Gov. Code section
12900), an employer can be strictly liable under the FEHA for sexual
harassment by a supervisor, and a plaintiff's damages do not include
those damages that could have been avoided with reasonable effort and
without undue risk, expense, or humiliation.

TODD v. PRUDENTIAL SECS., INC. (11/24/03 - No. 3 No. 126)
On certification, the court held that because the wage deductions
directed into the investment plan qualify as "payments for the benefit
of the employee," which are "similar" to the types of wage withholdings
authorized by the statute, the investment benefit plan at issue does not
violate New York Labor Law section 193.
