Plaintiff, prevailing in his 42 U.S.C. section 1983 action against the
police who arrested him, was inappropriately denied fees and costs.

POY v. BOUTSELIS (12/22/03 - No. 03-1201, 03-1243)

US v. SACCOCCIA (12/22/03 - No. 01-2160, 01-2170, 01-2393)
Defendant was convicted of RICO and other violations and ordered to
forfeit virtually all of his currency. The district court erred in
ordering his two attorneys to surrender such legal fees as they received
after defendant's conviction.

US v. COOPER (12/23/03 - No. 02-1584)
The summary contempt power of FRCP rule 42(b) was impermissibly used
where the allegedly contemptuous activity was failure to produce an
affidavit, and the violated instruction was given in an unrecorded
telephone conversation. Under such circumstances, the absence of a
written record of the order alleged to have been violated precludes a
conviction for criminal contempt.

QUINTERO v. CITY OF SANTA ANA (12/23/03 - No. G031275)acted as counsel for the Board
There was a clear appearance of bias and unfairness at an
administrative hearing before the Santa Ana Personnel Board, where a
city attorney that represented defendants before the Board had also
acted as counsel for the Board. The decision of the Board was therefore
reversed.
