District court correctly found disparate impact, intentional
discrimination, and a failure to grant reasonable accommodation, in
violation of both the Fair Housing Amendments Act and the ADA, where the
City refused to classify a home for recovering alcoholics and drug
addicts as a single family household, or to grant it a special-use
exception.

IN RE AQUATIC DEV. GROUP, INC. (12/17/03 - No.
02-5059)
The record does not support the Bankruptcy Court's conclusion that
debtor's delay in closing its bankruptcy case "resulted" from
circumstances sufficiently extraordinary to justify the rare and
powerful relief of retroactive closure. Granting a nunc pro tunc order,
which relieved the debtor of the obligation to pay statutory bankruptcy
trustee fees, was thus an abuse of discretion.

Bankruptcy Code Section 329, which deals directly with attorney's
compensation, does not supersede section 727, the discharge provision.
Since attorney fees are not among the debts excepted from discharge by
section 523, debts to the attorney defendants were discharged.

PRIMECO PERSONAL COMMUNICATIONS, L.P. v. CITY OF
MEQUON (12/18/03 - No.
03-1514, 03-1548)
Planning commission violated the Telecommunications Act section
332(c)(7)(B)(iii) by failing to support with "substantial evidence" its
decision to deny a permit to erect a cellphone antenna. 42 U.S.C.
section 1983 remedies are not available in suits to enforce rights
granted by the Telecommunications Act.

When defendant's stand-by counsel was approached by defendant's
wife
about her participation as a witness, the attorney was permitted under
Minnesota Rule of Professional Conduct 4.3 to advise her that she should
seek her own counsel, and his actions in doing so did not violate
defendant's right to represent himself.

In an infringement action between competing car audio manufacturers,
because this is an exceptional case under the terms of 15 U.S.C. section
1117(a), district court correctly awarded reasonable attorney fees to
plaintiff in its First Fee Order. Because defendant's subsequent motion
was frivolous and filed in bad faith, court correctly awarded additional
fees in its Second Fee Order.
